Website, purchase, and product-use terms for Standard Edition and Professional Edition

1. Acceptance of Terms

These Terms and Conditions ("Terms") govern access to and use of the AI Project Analyzer™ website, purchase pages, sales materials, downloads, activation instructions, support materials, and related services provided by Glen Lewis Media ("Glen Lewis Media," "we," "us," or "our"). By accessing the website, purchasing, downloading, installing, activating, or using AI Project Analyzer™, you agree to these Terms and the applicable End User License Agreement ("EULA").

If you do not agree to these Terms or the EULA, do not purchase, download, install, activate, or use the software.

2. Product and License Editions

AI Project Analyzer™ is Windows desktop software offered in Standard Edition and Professional Edition. Product features, capabilities, prices, and promotional terms are described on the applicable product page and purchase page. Your purchase grants only the license rights described in the EULA for the edition purchased.

No ownership rights are sold or transferred. The software is licensed, not sold.

3. Relationship to the EULA

The EULA is incorporated into these Terms by reference. The EULA governs installation, activation, permitted use, restrictions, intellectual-property rights, warranty disclaimers, limitation of liability, termination, and California governing law. If there is a direct conflict between these Terms and the EULA concerning software-license rights or restrictions, the EULA controls for that subject matter.

4. Payment Processor and Merchant of Record

Purchases may be processed by FastSpring or another authorized payment platform acting as merchant of record, payment processor, reseller, or ecommerce provider. Payment, tax, invoice, fraud-screening, refund-processing, and checkout terms may also be governed by the applicable payment platform terms presented at checkout.

Prices, taxes, currency conversion, and payment-method availability may vary by location and payment method. Product names and prices displayed on the public product page should match the checkout configuration used for the sale.

5. License Activation and Hardware Locking

AI Project Analyzer™ requires online activation using an activation code or license key supplied after purchase. The license may be locked to the hardware configuration of the computer on which it is activated. Activation may require communication with Glen Lewis Media, Protect Ebook.net, or another license-management provider.

You are responsible for safeguarding your activation key. You may not share, resell, transfer, publish, or otherwise disclose your activation key to any other person or entity except as expressly permitted in writing by Glen Lewis Media.

6. Customer Responsibilities

• Review all product descriptions, edition differences, system requirements, and refund terms before purchase.
• Use the software only in accordance with the EULA and applicable law.
• Maintain your own backups of project files, reports, business data, and other information used with the software.
• Use accurate purchase, contact, billing, and activation information.
• Do not attempt to bypass activation, licensing, copy-protection, security, or access-control features.

7. No Refunds / All Sales Final

All sales of digital software licenses are final except where a refund is required by applicable law, expressly approved by Glen Lewis Media, or processed by the merchant of record or payment platform under its fraud, erroneous-charge, or risk-control procedures. The separate Refund Policy is incorporated into these Terms by reference.

8. Support and Updates

Glen Lewis Media may provide support, updates, patches, or new versions at its discretion. Unless expressly stated in writing, purchase of a license does not guarantee future updates, upgrades, new versions, feature additions, custom support, consulting services, or compatibility with all future operating systems or hardware changes.

9. Website Content and Product Information

We attempt to keep website and product information accurate, but typographical errors, pricing errors, feature-description errors, or availability changes may occur. We may correct errors, update product information, modify website content, or change product offerings at any time, subject to applicable law and completed-purchase obligations.

10. Third-Party Services

The website, checkout, payment processing, delivery, licensing, activation, analytics, email, hosting, and support workflows may use third-party service providers. Third-party services are governed by their own terms and privacy policies. Glen Lewis Media is not responsible for third-party service outages, changes, or acts except to the extent required by applicable law.

11. Disclaimers and Limitation of Liability

The software and related materials are provided "as is" as stated in the EULA. To the maximum extent permitted by law, Glen Lewis Media disclaims implied warranties and will not be liable for indirect, incidental, special, consequential, or punitive damages. Glen Lewis Media’s total aggregate liability will not exceed the amount paid for the software license giving rise to the claim.

12. Privacy

Use of the website, checkout, purchase process, support process, and activation process may involve collection and processing of personal information as described in the Privacy Policy. The Privacy Policy is incorporated into these Terms by reference.

13. Governing Law and Venue

These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-law principles. Any disputes arising under or relating to these Terms, the website, or the software will be subject to the exclusive jurisdiction of the courts located in Sacramento County, California, except where applicable law requires otherwise.

14. Changes to Terms

We may update these Terms from time to time. The updated version will be identified by the “Last Updated” date. Continued use of the website, support services, or software after posting of revised Terms constitutes acceptance of the revised Terms to the extent permitted by law.
